Arizona Gets $5.9 Million in GM Driver-Data Settlement, Mayes Says

General Motors' Renaissance Center headquarters in Detroit

PHOENIX — Arizona will receive $5.9 million from a $220 million multistate settlement with General Motors over the automaker’s collection and sale of drivers’ data, Attorney General Kris Mayes announced.

More than 35 states and the District of Columbia joined the settlement, KTAR News reported. The states alleged GM collected driving behavior data through its Smart Driver program from 2016 to 2024 and sold it without drivers’ proper consent.

“Drivers were enrolled in data tracking without their knowledge,” Mayes said.

According to the settlement, about 370,000 OnStar drivers were given misleading information about the program.

Under the agreement, GM must follow new consent rules before collecting or sharing driving data and must delete data gathered before January 2025.

Information collected through programs like Smart Driver, including hard braking, speeding and late-night driving, can be used by data brokers and insurers to set rates, consumer advocates have warned.

Arizona drivers who believe their data was shared can contact the attorney general’s consumer protection office for more information.
