Manhattan Prosecutors Fight to Keep Mangione Murder Case Despite Federal Plea

New York County Courthouse in Manhattan

NEW YORK — Manhattan prosecutors moved Friday to keep their murder case against Luigi Mangione alive, arguing his federal guilty plea should not end the state prosecution over the killing of UnitedHealthcare CEO Brian Thompson, the Associated Press reported.

The cases involve “different harms, different evils, different purposes, different crimes,” Assistant District Attorney Joel Seidemann and colleagues wrote in a filing.

Mangione’s lawyers want the state murder and weapons charges dismissed on double jeopardy grounds, arguing the state and federal governments are “prosecuting the same man twice for the same event.”

Double jeopardy broadly bars prosecuting a person repeatedly for the same crime, but the rules can be complicated when separate courts are involved, the AP noted.

At stake is whether Mangione faces a state trial and how much prison time he could ultimately serve.
