Albany, NY -The New York State Commission on Judicial Conduct has called for the suspension of Hon. Erin P. Gall from her position as Justice of the Supreme Court for the Fifth Judicial District, Oneida County, following serious allegations of misconduct.
In a letter dated July 22, 2024, addressed to Hon. Lisa LeCours of the Commission, the Court was informed of the Commission’s determination, dated July 17, 2024, which recommended the removal of Judge Gall from her judicial role. According to Article VI, Section 22(e) of the New York State Constitution and Section 44(8) of the Judiciary Law, a judge who faces a removal determination from the Commission may be suspended, with or without pay, while the Court deliberates on the matter as per Section 44(7) of the Judiciary Law.
The Commission’s recommendation is based on concerns that public trust in the judiciary and the justice system would be compromised if Judge Gall were allowed to continue in her judicial capacity while the removal process is underway. The allegations against Judge Gall are particularly grave, involving a public outburst characterized by offensive and profane language, racially insensitive remarks, threats of gun violence, calls for police to ignore the law, and promises of preferential treatment for law enforcement.
In light of these serious allegations and the potential impact on public confidence, the Commission has suggested that Judge Gall be suspended with pay pending the Court’s final decision on her removal. This recommendation aligns with the Court’s established practice of suspending judges with pay during such proceedings.
The Court is expected to consider the Commission’s recommendation as it moves forward with the case.
