A California appeals court has ruled that a lawsuit claiming HBO Max’s “The Pitt” is an unauthorized reboot of “ER” can move forward, CBS News reported.
A three-judge panel of California’s 2nd District Court of Appeal ruled unanimously Wednesday that a trial judge correctly refused to throw out the case against Warner Bros. Television, which produced both shows.
The panel did dismiss Noah Wyle, who starred in both series and is a producer on “The Pitt,” along with two other producers who worked on both shows.
The suit was filed by Sherri Crichton, widow of “ER” creator Michael Crichton, and his estate. Crichton, the author of “Jurassic Park,” wrote the pilot for “ER,” which ran on NBC from 1994 to 2009.
The ruling does not decide whether “The Pitt” infringes on “ER”; it allows the case to continue in trial court.
